This Privacy Policy describes our policies and procedures regarding the collection, use, and disclosure of your information when you use the service, and informs you about your privacy rights and how the law protects you. At Morada Segura, S.L.L. (hereinafter referred to as “Moradai”), our purpose is to comply with Regulation (EU) 2016/679 of the European Parliament and of the Council of 27 April 2016 on the protection of natural persons with regard to the processing of personal data and on the free movement of such data, as well as the Recommendations and Guidelines issued by the Spanish Data Protection Agency (A.E.P.D.).

We use your personal data to provide and improve the service. By using the service, you agree to the collection and use of information in accordance with this Privacy Policy.

1. Definitions

  • User: any natural person who provides their personal data to Moradai and whose data is processed by Moradai, regardless of the purpose of such processing.

  • Service: all services provided by Moradai, including but not limited to web services, mobile applications, physical product sales, or any other offerings.

2. Comprehensive Services

This Privacy Policy applies to all services offered by Moradai, including but not limited to the public website, web-based user dashboard or account, and the mobile application. The type of data collected may vary depending on the specific purpose of processing and the legal basis involved. It is the responsibility of the user to read and accept this Privacy Policy prior to submitting any personal data to Moradai through any of its services, whether digital or otherwise.

3.  Data We Collect and Purpose of Processing

Moradai will process your personal data for the following purposes, depending on the products and services you request or any other interaction you may have with Moradai:

Contact Form Submission: By completing and submitting any contact form on the website or app, or by contacting Moradai through any other channel in which you provide personal data (for inquiries, proposals, claims, or any other reason), we collect the following personal data in order to handle your request in a personalized manner and through appropriate, efficient, and tailored communication channels:

  • Identification data (full name)

  • Contact details (email address and mobile phone number)

Subscription to Newsletter or Blog: By completing and submitting any form or directly requesting a subscription to our newsletter or periodic communications, we collect the following personal data to provide such communications through appropriate means:

  • Identification data (full name)

  • Contact details (email address)

Purchase of Moradai Physical Products: When purchasing physical products through any official channel or service, either digitally or by directly contacting Moradai, we collect the following personal data to fulfil the contract, process payment, ship and deliver the order to the requested address, communicate updates or issues related to the order, and provide personalized customer support

  • Identification data (full name, national ID)

  • Shipping information (shipping address)

  • Billing information (billing address)

  • Contact details (email address, mobile phone number)

  • Payment method

  • Payment data (for security reasons, we never store your full card number and work with third-party payment processors that ensure a high level of security)

  • Statistical data (in some cases, we may request data solely for statistical purposes, such as type of housing, how you found us, or the security systems currently used in your home)

Download of Free Digital Products from Moradai: When downloading any digital products through any official Moradai channel or platform, we collect the following personal data in order to grant you access to the product and send you related communications:

  • Identification data (full name)

  • Contact details (email address and mobile phone number)

Registration and Use of the Moradai App: When registering on the Moradai App or the web user portal, the user submits personal data to gain access to the functionalities of the service. We collect your personal data in order to provide all contracted service features, manage secure access, deliver technical support and assistance, and communicate with you regarding any aspect of the service:

  • Identification data (full name, national ID)

  • Housing data (address, housing type, property owner details)

  • Contact details (email address, mobile phone number)

  • Password (we manage your passwords securely using industry-standard encryption techniques)

  • Facial photograph

  • Geolocation data (only during the initial account setup)

  • Device data (IP address, Wi-Fi network SSID)

Use of Moradai Physical Products: If you contract Moradai's physical products for residence certification, such as El Testigo, the provision of the service will include the processing of biometric data, which will be handled locally and automatically by the device, using the highest security standards. Moradai will not access, store, or share your biometric data, which will remain securely stored on your device at all times. Likewise, Moradai will not retain your biometric data after the termination of the service. If you choose to delete your account, your biometric data will be permanently erased from the device’s storage, and it will not be possible to recover the service or previously stored data should you choose to reactivate the service in the future.

4. Legal Bases for Processing

The legal bases for processing your data are as follows:

  1. Contractual performance. The following processing activities are based on the performance of a contract: 

    • Purchase of Moradai physical products

    • Registration and use of the Moradai App and other Moradai products and services

    • Communications related to the service that require decisions or actions by the user

  2. Legitimate interest. The following processing activities are based on our legitimate interests:

    • Protecting the service and Moradai users in the event of improper or fraudulent use

    • Conducting surveys, studies, or requesting user feedback to improve the service

    • Complying with requests from law enforcement agencies, courts, or other competent authorities

    • Communications related to the service that require decisions or actions by the user

  3. Consent. The following processing activities are based on the express consent provided by the user:

    • Completion of web forms

    • Subscription to the newsletter or blog

    • Sending of commercial information

    • Processing of payments or subscriptions for services

  4. Legal obligation. The following are based on compliance with legal obligations:

    • Verifications required by law, such as age or identity checks

    • Retention of your personal data after the contractual relationship ends, for the legally prescribed period

    • Compliance with requests from law enforcement agencies, courts, or other competent authorities

5. Information Shared with Third Parties

Your personal data may be shared with third parties in the following cases:

  • Third-party service providers acting on behalf of and under instructions from Moradai, with whom we have entered into appropriate data processing agreements (data processors). For example, for the processing of electronic payments.

  • Third parties necessary for the proper provision of the service, who will act as independent data controllers, provided you have given your express consent. Such third-party transfers will be clearly specified in the applicable terms and conditions of the service, which must be accepted by the user to proceed with contracting.

  • Courts of law, the Public Prosecutor's Office, relevant Public Authorities, and law enforcement agencies, particularly data protection authorities, in order to meet legal obligations or respond to legal claims arising from data processing.

6.  Data Retention

The duration of data retention depends on the purpose of processing. Only the minimum data necessary to fulfill the purposes outlined in section 3 will be retained, as well as to comply with legal obligations:

Data retained until deleted by the user: You have the right to delete certain personal data at any time without closing your account—such as your profile picture or some billing information. Such data will be stored only for as long as you choose. 

Data retained until your Moradai account is deleted: You may request the deletion of your Moradai account and termination of the contract, in accordance with the terms set out in the applicable Terms and Conditions. Until the account is deleted, we will retain your access data (e.g., email, password) and any other data required for providing the contracted service (e.g., national ID, address, phone number, facial photograph). Once deleted, you will lose access to the service and all related data, including historical records such as residence logs or certificates. This deletion is irreversible.

Data retained for extended periods: After account deletion, some data will be retained for longer periods but for very limited purposes. Moradai will retain the user's personal data required to fulfill legal obligations, such as those established under the General Tax Law or the Commercial Code, for a period of six years. This includes user identification data and service-related data such as name, national ID, address, products purchased, prices, payments, incidents, etc. These data will not be processed for purposes other than those legally required.

7.  User Rights

You may exercise your rights of access, rectification, erasure, objection, restriction, data portability, and withdrawal of consent at any time and free of charge. You also have the right not to be subject to a decision based solely on automated processing. You can exercise these rights by submitting a request to the designated channel, accompanied by documentation verifying your identity (such as your national ID/NIE), if requested.

It is also your responsibility to keep your data up to date. You may update or modify your data following the procedure described above. Moradai shall not be held liable for any consequences arising from your failure to update your data or if you provide false or inaccurate information. 

Additionally, you may file a complaint with the Spanish Data Protection Agency (Agencia Española de Protección de Datos – www.aepd.es), located at Calle de Jorge Juan, 6, 28001 Madrid, if you believe that Moradai has infringed or failed to properly address your data protection rights.

8.  International Transfers

In order to properly provide certain services, Moradai may transfer users’ personal data to service providers located outside of Spain. These data transfers are carried out only when necessary and exclusively to countries within the European Union, where user data protection rights are guaranteed under EU regulations.

9.  Minors

Moradai’s services are intended only for users of legal age. We do not knowingly collect personal data from minors. If you are underage, do not use Moradai's services or provide us with any personal data.

Parents or guardians who become aware that their child has provided personal data to Moradai should contact us, so that we can take appropriate action to delete the minor’s data.

If we discover that we have collected personal data from a minor, we will take the necessary steps to delete the data. This may require the immediate deletion of the minor’s Moradai account.
