What is considered a dwelling/residence?Dwelling is any space in which a person exercises their personal and intimate life and is a right protected by the Spanish Constitution. Its non-consensual occupation entails the crime of home intrusion (allanamiento de morada), which is punishable by prison sentence under Spanish law.

Is a temporary residence a dwelling?Yes, your residence on the beach, your countryside house or any other property that you use frequently, is considered your home and, therefore, is protected by the rights and laws relating to it. It is a common mistake to consider exclusively a person's main home as dwelling.

Is an empty property that is not used considered a dwelling/residence?No, an uninhabited property or one that is not in use does not constitute a dwelling or residence. The occupation of this type of property without the consent of the owner entails a crime of usurpation, the penalty for which is lower and the associated judicial procedures are much longer and more complex.

Can my temporary residence or even my first home become occupied?Yes. Although the law condemns home invasion and the State Security Forces must intervene immediately, the difficulty is often in proving that the occupied property is your dwelling and not a disused property, which do not benefit from the same legal protection. Neither the deeds of the property, the municipal census registration or the supply invoices provide sufficient proof of the condition of residence. This generates doubts in police and judicial authorities, requiring the study of the evidence and extending the process for at least 6 months. A habitual residence, without sufficient evidence, could remain illegally occupied for months or even years.

How does Moradai work if my property is occupied?If you detect that your property has been occupied, either through the Moradai detection system or on your own, you can immediately notify us of the incident via mobile app. Our team will issue an automatic report with the evidence, demonstrating your status as a resident and will present it to a notary for the generation of a notarial act. This document will be immediately presented to the authorities so that they can take the appropriate actions and return possession of the property.

Can I manipulate the product so that a property that is not an actual dwelling appears to be?No, although it is an attractive idea, to guarantee maximum reliability and probative value, Moradai has been designed to detect any attempted fraud, immediately losing all legal validity of the evidence generated over time. Those properties that are not in use and, therefore, do not have the status of residence, do not have full protection.
